‘This Isn’t Some Game’: Mueller And Trump’s Legal Team Feud Over Possible Presidential Subpoena

It is being reported that Special Counsel Robert Mueller considered a subpoena for President Trump and his legal team if they refused to sit down with his investigative team.

The stunning announcement sent members of Trump’s legal team into a fury, with one of them replying, “This isn’t some game.”

“You are screwing with the work of the president of the United States,” Trump’s then-lawyer John Dowd also replied, as the Hill reports.

Mueller made the comment in response to the Trump legal team’s argument during a March meeting that the president wasn’t obligated to speak with federal investigators in the probe into Russian election interference, according to the Post.

Dowd, who was leading the response to Mueller’s probe on Trump’s personal legal team, abruptly left the legal team in March.

The Post reported Tuesday that in the wake of the March meeting, Trump’s attorneys created a list of questions they believed that Mueller’s team would ask the president during an interview.
Those questions were based off the topics that investigators told Trump’s lawyers they wanted to discuss with the president.

The list of questions includes inquiries about the decisions to fire national security adviser Michael Flynn and FBI Director James Comey; whether Trump communicated with Russian President Vladimir Putin during the campaign; and the president’s reported attempts to fire Mueller.


While Trump did respond to the questions released on Monday, he did not mention whether he was considering sitting down with the special counsel.

Trump tweeted, “So disgraceful that the questions concerning the Russian Witch Hunt were “leaked” to the media. No questions on Collusion. Oh, I see…you have a made up, phony crime, Collusion, that never existed, and an investigation begun with illegally leaked classified information. Nice!”

And, “It would seem very hard to obstruct justice for a crime that never happened! Witch Hunt!”

Most recently, Trump added: “There was no Collusion (it is a Hoax) and there is no Obstruction of Justice (that is a setup & trap).”

He later tweeted a quote by Joe Digenova, a former US Attorney, “The questions are an intrusion into the President’s Article 2 powers under the Constitution to fire any Executive Branch Employee…what the President was thinking is an outrageous…..as to the President’s unfettered power to fire anyone…”

A presidential subpoena would undoubtedly add more drama to what Trump has repeatedly called a “hoax” and a “distraction.”

A source familiar with the proceedings told NBC News on Tuesday night that the president’s new legal team, led by former New York Mayor Rudolph Giuliani, is still getting up to speed and that no decisions have been made. A White House official familiar with the proceedings said nothing had been taken off the table.

NBC News reported last month that Trump’s legal team had discussed making the case that a sitting president can’t be force to comply with a subpoena, according to people familiar with the discussions. The argument hinges on the idea that a sitting president can’t be indicted and if a president can’t be indicted, he can’t be forced to comply with a subpoena.

Trump’s personal attorney, Jay Sekulow, said Tuesday night: “We do not discuss conversations we have or have not had with the Office of Special Counsel.” Ty Cobb, a member of Trump’s White House legal team, had no comment.
