‘I’ll Fight To Make Sure There Are No Hearings’: Democrats Look To Stand In The Way Of Replacing Justice Kennedy

Supreme Court Justice Anthony Kennedy retired on Wednesday, thus giving Trump a chance to name his replacement. Democrats like Senator Kirsten Gillibrand, however, look to stand in the way and prevent President Trump from nominating a replacement for the 81-year-old Justice.

Gillibrand has vowed to “fight” against Trump’s efforts and said she would not even allow a Senate hearing for a prospective nominee. The New York Democrat claimed a new conservative judge would use the court to outlaw abortion.

“Any one of President Trump’s list of proposed SCOTUS justices would overturn Roe v. Wade and threaten our fundamental rights,” Gillibrand tweeted. “I’ll fight to make sure there are no hearings to replace Justice Kennedy until after the election.”

“This is our democracy. Let’s fight like it,” she added, encouraging her supporters to march in protest.

Other Democrats are looking to push the nomination process until past the congressional elections in November. They are undoubtedly anticipating such a delay would help more Democrats to be elected in both legislative chambers. Per Fox News:

While it is not clear whom Trump will nominate, the eventual nominee is likely to face resistance from Senate Democrats — who are still bristling from Senate Republicans’ blockade of Obama-pick Merrick Garland in 2016 and would balk at the possibility of Trump hardening the conservative bloc on the court.

Kennedy’s retirement comes after both Gorsuch and Kennedy were key votes in two controversial decisions this week — upholding Trump’s ‘travel ban’ and ruling against union’s ‘fair share’ fees.

Both decisions were 5-4.

California Congressman Ted Lieu said, “The American people should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new Congress.”

A lawyer representing a case against President Trump said, similar to Gillibrand, that people should “fight like hell” and do “whatever it takes” to stop a conservative judge from being nominated.

“The consequences flowing from Justice Kennedy’s replacement cannot be overstated,” the lawyer tweeted. “They are not confined to only those facing minority groups. They will be pervasive throughout our society for decades. It is time to fight like hell!”

Speaking on the urgency for voters this Fall, Republican strategist Chris Wilson said this Supreme Court vacancy will have a tremendous effect.

“It’s a game changer,” Wilson said, per Fox News. “There’s no piece of legislation, no executive order, no Supreme Court decision that would have created the level of motivation that an empty seat does.”
