Democrats Respond To Texas Judge Ruling Obamacare Is Unconstitutional, Promise To ‘Fight This, Tooth And Nail’

The fight over Obamacare is far from over as Democrat Senate Leader Chuck Schumer is looking to contest the recent ruling of a Texas judge that the Affordable Care Act—commonly known as Obamacare—is unconstitutional.

On Friday, U.S. District Court Judge Reed O’Connor ruled Obamacare violates the constitution because Republican lawmakers stripped it of the law’s individual mandate. The clause, according to the judge, was the linchpin of the law’s constitutionality.

Schumer called the ruling “awful” and said Democrats plan “to fight this, tooth and nail,” Daily Mail reports.

“It’s an awful, awful ruling. We’re going to fight this, tooth and nail. And the first thing we’re going to do, when we get back there in the Senate, is urge – put a vote on the floor urging an intervention in the case,” Schumer said on NBC’s “Meet the Press.”

“If a majority of the House and a majority of the Senate say that this case should be overturned, it’ll have a tremendous effect on the appeal,” Schumer continued.

Schumer and Democrats sought to blame Republicans for the ruling.

The GOP will face dire consequences for it, Schumer warned.

‘It’s an awful, awful decision. And it puts a lot of our Republicans in a box. Because they sort of were, once – you know, two-faced. On the one hand, they said they want to preserve pre-existing conditions and preserve health care. On the other hand, Donald Trump and a large number of Republicans brought this court suit. So there are going to be a good number of Republicans who are going to really have to make a decision whether to join us in this intervention or face very severe consequences,’ Schumer said.


Democrat Senator Dick Durbin said the lawsuit which undercut Obamacare would negatively affect Republicans in the polls.

“I think the judge, the Republican attorneys general who brought this lawsuit, didn’t do the Republican Party any favor. The largest issue in the last election, November 6 election, that moved 40 seats from the Republican column to the Democratic column in the House, the biggest single issue was the Affordable Care Act and whether it would cover people with pre-existing conditions,” Durbin said on ABC’s “This Week,” Daily Mail reports.

President Trump responded to the decision in a trip of tweets where he applauded the judicial ruling.

“As I predicted all along, Obamacare has been struck down as an UNCONSTITUTIONAL disaster!” Trump wrote in a tweet on Friday. “Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions. Mitch and Nancy, get it done!”

“Wow, but not surprisingly, ObamaCare was just ruled UNCONSTITUTIONAL by a highly respected judge in Texas,” the president added. “Great news for America!”

In a tweet on Monday, Trump wrote: “The DEDUCTIBLE which comes with ObamaCare is so high that it is practically not even useable! Hurts families badly. We have a chance, working with the Democrats, to deliver great HealthCare! A confirming Supreme Court Decision will lead to GREAT HealthCare results for Americans!”

White House adviser Stephen Miller also responded, per the Daily Mail: “Obamacare was ruled to be unconstitutional. We’ve always known that Obamacare was unconstitutional.”

“The more important question is whether Democrats are going to work with Republicans once Obamacare is ultimately struck down, which we believe it will be, to come up with a replacement plan that protects preexisting conditions,” Miller continued.

And: “This president working with members of both parties would be able to replace it with something that not only expands choice, expands competition, enshrines purchasing across state lines, but also protects preexisting conditions in a much better way than the current law does.”
