BREAKING NEWS: McCabe Wants Immunity

Former Deputy Director of the FBI Andrew McCabe has reportedly asked for immunity before he is scheduled to testify before a congressional hearing.

McCabe, who was fired for “lacking candor” or lying by Attorney General Jeff Sessions, is looking to score a deal with Congress ahead of his testimony before the Senate Judiciary Committee. The committee, which is headed by Chairman Chuck Grassley, is hosting the hearing on the FBI’s handling of the Hillary Clinton email investigation.

As Fox News reports, the request for immunity was sent via a letter to the Senate Judiciary Committee by McCabe’s attorney, Michael Bromwich. In the letter, McCabe asked to be granted immunity “in exchange for testimony surrounding the inspector general’s report that he leaked information and lied about it to former FBI director James Comey.”

Bromwich told the senator, “McCabe welcomes your invitation to testify and is eager to answer any questions that you or other members of the Committee have,” adding that because of his “criminal referral” by the inspector general, he could face prosecution.

“We hereby request that the Judiciary Committee authorize a grant of use immunity to Mr. McCabe,” adding that the “no testimony or other information provided by Mr. McCabe could be used against him in any criminal case.”

There is no indication from the committee yet as to whether or not they will answer McCabe’s request. It is clear, from the contents of the letter, that McCabe would not testify before the committee if he is not granted the immunity:

But Bromwich provided, in his letter to Grassley, information about emails that “demonstrate that Mr. McCabe advised former Director Comey, in October 2016, that Mr. McCabe was working with FBI colleagues to correct inaccuracies before certain media stories were published.”

McCabe was prevented from providing the emails themselves because of a non-disclosure agreement he was forced to sign by the FBI upon his termination and more information surrounding his account is unlikely to be revealed unless he is granted immunity, his lawyer said.

“Mr. McCabe is willing to testify, but because of the criminal referral, he must be afforded suitable legal protection,” Bromwich said in the letter to the committee, per CNN. “This is a textbook case for granting use immunity. . . . If this Committee is unwilling or unable to obtain such an order, then Mr. McCabe will have to no choice but to invoke his Fifth Amendment privilege against self-incrimination.”

As CNN also reports, Grassley has asked several former FBI officials to testify to the committee ahead of the release of an internal Justice Department report. The Inspector Generals report is expected to detail what went on behind the scenes during the Hillary investigation, including any missteps or leaks. FBI Director James Comey and former Attorney General Loretta Lynch have also been asked to testify:

The inspector general’s report has not yet been released, but Grassley has invited former FBI Director James Comey and former Attorney General Loretta Lynch to testify as well, according to those familiar with the plans.

The stakes for McCabe’s appearance, however, are particularly high. The former No. 2 at the FBI is entangled in a separate criminal investigation stemming from an earlier report from the inspector general’s office that concluded he lied to internal investigators. McCabe has steadfastly denied wrongdoing, but any congressional testimony he provides could have serious implications for his criminal case.

The hearing is slated for next Monday while there is no indication when the IG report will be released. The report could be more than 500 pages in length and reportedly details the events leading up to the 2016 presidential election.
