On Monday, California Attorney General Xavier Becerra led the charge in what is now a multi-state lawsuit against the Trump administration.
As Washington Examiner reports, “The California attorney general has filed suit against the Trump administration after the Commerce Department announced the 2020 census will include a question regarding citizenship status.”
Becerra argued the immigration question was an overreach of the government and was inadvertently affecting states with higher immigrant populations.
Subsequently, New York Attorney General Eric Schneiderman called the new question “reckless” and has joined the lawsuit similarly arguing the question could result in the loss of billions of federal dollars to his state.
“A fair and accurate count of all people in America is one of the federal government’s most solemn constitutional obligations,” Schneiderman said in a statement. “The Trump administration’s reckless decision to suddenly abandon nearly 70 years of practice by demanding to know the citizenship status of each resident counted cuts to the heart of this sacred obligation – and will create an environment of fear and distrust in immigration communities that would make impossible both an accurate Census and the fair distribution of federal tax dollars.”

“This move directly targets states like New York that have large, thriving immigrant populations – threatening billions of dollars in federal funding for New York as well as fair representation in Congress and the Electoral College,” the attorney general added.
And, “My office willl lead a multi-state lawsuit to protect New Yorkers, preserve a fair and accurate Census, and hold the Trump Administration accountable for violating both the 14th Amendment and the Enumeration Clause of the United States Constitution.”

In an op-ed the California attorney general argued the question was “an extraordinary attempt by the Trump administration to hijack the 2020 census for political purposes.”
“California, with its large immigrant communities, would be disproportionately harmed by depressed participation in the 2020 census,” Becerra wrote with California secretary of state Alex Padilla. “An undercount would threaten at least one of California’s seats in the House of Representatives (and, by extension, an elector in the electoral college.) It would deprive California and its cities and counties of their fair share of billions of dollars in federal funds.”
