A woman from Fresno, California took her children on a trip to Pismo Beach where they collected what they thought were seashells but were actually 72 protected Pismo clams.
She was fined over $88,000 by the Department of Fish and Wildlife for violating regulations.
While regulations aim to conserve declining clam populations, the excessive fine shocked the woman and ruined her family’s trip.
“It was just really sad, it made me really sad and depressed, and you know, it kind of ruined our trip,” Charlotte Russ said.
A local judge understood it was an honest misunderstanding since they were not locals and reduced the fine to $500, showing balance between environmental stewardship and understanding human mistakes.
“The reason … we have these regulations is because we have to let them get to four-and-a-half inches so they can spawn, so they can have offspring every year, and they have juvenile clams,” Lt. Matthew Gil from the Department of Fish and Wildlife stated.
