Hunter Biden’s plea deal fell apart in open court as major problems were exposed.
Judge Maryellen Noreika informed Hunter that he is still under federal investigation and is unable to accept the special deal from federal prosecutors. Making matters worse, Hunter’s lawyers are facing sanctions over an accusation that they committed a serious ethical violation.
Hunter’s lawyers allegedly impersonated a government attorney in order to “scrub” evidence by having an amicus (or “friend of the court”) brief removed from a filing in his criminal tax case.
Judge Noreika is threatening Biden’s legal team with sanctions after allegedly lying to the clerk’s office.

When the judge asked where he worked, Hunter responded, “The Ukrainian energy company was Burisma.” He failed to mention his income related to business ties to the Chinese energy company, CEFC.
Judge Noreika asked Biden, “You did know that you owed tax money, right?”
“Yes, your honor,” Biden responded.
Hunter was slated to plead guilty to two tax misdemeanors for 2017 and 2018 while avoiding tax-related crimes for the preceding three years.

In exchange for the guilty plea, prosecutors will reportedly drop the more serious gun felony charge carries a maximum penalty of 10 years in prison. This plea deal was intended to avoid any jail time in connection to the felony gun charge.
Hunter illegally possessed a firearm while addicted to crack cocaine. He tested positive for the drug and was discharged from the Navy in 2014. To purchase the weapon, Hunter lied on a federal gun purchase form.
Less privileged Americans are regularly “dragged through the mud” and face the full consequences of their criminal acts. For example, the popular rapper Kodak Black, whose real name is Bill Kapri, committed the same crime and sentenced to nearly four years in prison. Kodak Black also lied on a federal form to purchase a gun by using an incorrect Social Security number.
Hunter’s plea deal has been widely condemned as a corrupt and politically motivated move by the Justice Department. U.S. Attorney General Merrick B. Garland has denied interfering in the case. Two veteran IRS agents have come forward as whistleblowers and allege blatant interference and political corruption in the case.
Regarding the scrubbing of evidence, the amicus in question is 448 pages of congressional testimony from IRS whistleblowers.
“Someone from Hunter’s attorney Chris Clark’s former law firm called the Delaware clerk, allegedly pretending to be from the office of Chairman Smith’s attorney, Theodore Kittila, asking the court to remove the original filing – and the attached 448-pages of Congressional testimony from the whistleblowers,” the report found.
“The documents were then taken down and sealed,” the report added.

Judge Maryellen Noreika openly questioned the constitutionality of Hunter’s plea deal because “the diversion clause and the immunity Hunter Biden would receive.”
“Prosecutors on Wednesday, though, said Hunter Biden pleading guilty to the two misdemeanor tax offenses would not immunize him from future charges,” the report said.
“At one point, Noreika asked Justice Department prosecutor Leo Wise whether there is an ‘ongoing investigation here,'” the report added.

“There is,” Wise responded. Prosecutors refused to tell the judge why Hunter is still under investigation.
When asked if the government could potentially bring a charge related to the Foreign Agents Registration Act (FARA), Wise responded, “Yes.”
“At that point, the original plea deal broke down,” the report concluded.
